| B. Application for Certificate |
(1) Persons who want to get GAP certificate should submit the application form with attachments to private certification authorities (Regulation No. 15-2)
(2) Qualification: Individual producing farmhouse and producers¡¯ organization, etc
(3) Application form: Regulation No. 4-2 Form
(4) Attachments: A land registration map and production plan |
1) A land registration map of the cultivation plan farmland: Issued by the local governments
2) Production plan for certified items (Illustrate): NAQS Notice Appendix. 1 Form |
| - Must be prepared per certificate applicant(per member in case of producers¡¯ organization), and all of the items, that the applicant is planning to cultivate during the term, should be on the item section of an application for certificate |
| (5) Service charge: 50,000 won + travelling expense of inspectors |
| * Travelling expense: Public servant rank 5 base, per a person per a day plus days to go and to come |
(6) Term for treatment: 42 days from the date of receiving application
(7) Plan and inform the inspection plan once receiving application |
1) When planning the inspection, certificate authority shall visit the farm beforehand, and schedule the inspection after consultation with the applicant
2) Inspection date, terms, inspectors, etc shall be included in inspection plan |
| C. Inspection |
| (1) Inspection method and procedure |
1) Documentation: Reasonableness of mentioned items in registration form, Record of production plan for certified items, Land registration map of planned cultivating farmland and its reasonableness
2) Based on document inspection, questions, that will be asked during field inspection, will be arranged in the concrete
3) Field inspection: Interview with the applicant, Condition of farmland, Surrounding circumstance per package of certification application, Fertility, Condition of growing crops, Correspondence of Record of the farmhouse and farmland, Crops and seeds, Cultivation packaging and method, Management of land not in use, Water, Quality control of products, Existence of habitual cultivation, and if exist, the quantity of hazard substance used and products, etc |
| (2) Examination and analysis of soil, water, products, etc |
1) Soil and water shall be inspected more than once in three years (Inspection within recent 3 years will be recognized)
2) Products, etc: In case where the items are shipped during the inspection, sample will be picked and analyzed. Although the items are not produced but appear to be contaminated by contaminants, sample of crops will be picked and inspected. In this case, any costs for inspection and analysis will be charged to the applicant. |
| (3) Sampling: Sampling of soil, water, products, etc shall follow the procedure and methods set by Ministry for Food, Agriculture, Forestry and Fisheries |
| (4) Inspection method for producers¡¯ organization |
- Sampling members from the producers¡¯ organization can be possible. When sampling is used sample number should be decided accord to the number of members

| (5) Inspection criteria |
| (6) Inspect prescribed criteria by criteria from the certified standard |
1) Management Control : Keep the documents for the minimum of 1 year, other recording articles are prescribed in detail
2) Packaging: Reasonableness of farmland in accordance with Soil Contamination Control Act Enforcement Regulation, if condition of physical/chemical conditions, including salts, heavy metal, etc, got worsened, Reasonableness of conversion period, Native plant in natural condition, etc
3) Water: Reasonableness of underground water, Lake and marshes water, River water, etc as an agricultural water
* Refer the method of collecting soil and water to NAQS Notice(Appendix 1)
4) Crops: Crops from genetically modified farm products can be used only if indicated on the package
5) Cultivating Method: Use fertilizer and agrichemicals according to corresponding regulation
6) Quality control of products: Keep clean during storage and delivery, and prevent contaminating from outside, regulation on pest control and controlling method, regulation on pest control and controlling method during the storage and delivery, way to preserver quality during the delivery, prohibit radiation inspection, packing material and quality, allowance standard on remaining agrichemical and exceptions |

| D. Conclusion of Inspection Result |
| (1) Standard of Conclusion |
1) Committee: Committee members who are legislative organ, of certificate authority will determine the issuance of certification and decision should be made in accordance with the operating standard of the committee
2) Compliance with the standard: Certificate standard of certificate authority must be conformed while making decision
3) Inspection Criteria: Inspection should follow the certificate inspection criteria(GAP certificate standard) which is made solely by certificate authority
4) Decision of appropriateness: It must be appropriate to committee regulation of certificate authority |
| (2) Treatment for disqualified person from member(Setting the standard) |
- In case where applied as an organization, sample farmhouse will be picked and inspected. If a disqualified person were found as a result, the whole organization members will be disqualified. However, one last chance will be given. In such case, new sample farmhouse will be picked and the organization can be qualified except for the disqualified member(Refer to NAQS Notice Appendix1)

| (1)Logo: The size of loge can be adjusted to the size of packing material, but its shape and words cannot be changed
|
| (2)Growing district: A territory where they produced the agricultural products, including the name of city/province or city/county/district in accordance with rule of origin
|
| (3)Item(Description): Indicate in conformity with ¡ºSeed Industry Law¡»Clause 2-4 or ¡ºAgricultural Products Quality Control Law Enforcement regulation¡» Article VI clause 2-3
|
| (4)Weight/Quantity: Actual weight or number per package
|
| (5)Grade: Standard size should be used for the object items of standard size, and prescribe size by other regulations will be used when standard size is absent

| (6)Producer: the name, address, telephone number of the producer
|
| G. Renewal of Terms |
| (1) Apply within 30 days of the end of term of validity(Form enforcement regulation 4-4) |
1) Procedure: after review the application contents, renewal will be accepted unless disqualified
2) Renewal period: In conformity with NAQS Notice ¡°Appendix 3¡± in item by item |
(2) General agricultural products: Cultivating period + period of circulation of one year
(3) Dry agricultural products: Cultivating period + period of circulation of two years
(4) Ginseng and its kind: Cultivating period + period of circulation of 10 years (one year for undried ginseng)
(5) Crops for medicinal use: Cultivating period + period of circulation of five years
(6) Appropriate: Renewal approved in accordance with the decision of legislative organ of Certificate authority |
- In case of disqualification as a result, letter with the reason for disqualification will be sent in accordance with the decision from Certificate authority

| ¡Ø In case where certified person who wants to continuously produce certified item, and apply within the term of validity, he/she only has to submit the items with any change in attachment |
| H. Change in Certificate Subjects |
| When the certified person wants to change the production plan and the size of farming for the certified items within the term of validity, application for the change in producing plan of certified item should be submitted |
- Application for change in certification: NAQS Notice No. 2 form
- Inspection: Inspect in case of increase, and inspection will be omitted in case of decrease
- Certificate No.: Previous no. will be used |
| I. Educating Certified Farmhouse |
(1) Education institute: Rural Development Administration
(2) Educating certified farmhouse: Training from farming technique center and province Agricultural Research & Extension Services has to be completed(mandatory)
(3) Duty of certified person: Regulations including conformity of certification standard, commitment to inspection and confirmation from certificate authority, sincere documentation, conformity of indicated details
(4) Education on producing certified items of certificate authority, etc
(5) Prohibition of falsehood exaggerative advertisement, etc |
| J. Continuing Control |
| (1) Inspection of producing process |
| 1) Certificate authority should inspect the producing process of the certified items minimum of once a year |
| * In case where certificate authority cannot inspect due to cancellation of authorization, an agency from NAQS of jurisdiction will do the duty |
2) Inspection with sampling will be possible in case certified as producers¡¯ organization
3) Inspection provision |
- Seeding stage: GMO crops or not, correspondence of actual cultivating area with the planned one, etc
- Growing stage |
4) Management criteria of cultivation packing including fertilization, pest control, input of various material, etc
5) Conformity of agrichemical safety standard and reasonableness in use of chemical fertilizer
6) If certified items are damages from cold weather, hail, pest etc
7) If the use of agrichemical has to be confirmed, the most likely place will be picked and sampled(products, crops, soils, etc), and analysis of remaining agrichemical will be asked |

| * Especially, when the violation is found as a result of inspection, clear and accurate evidence such as photograph has to be secured to prove the violation condition |
| (2) Inspection of the items on the market |
1) Inspection of the items on the market will be done minimum of once a half of quarter year by NAQS
2) Inspection criteria |
- Correspondence of every kind of indication and contents, and indication method, reasonableness of words
- Inspect the safety of agricultural products
- If it is certified farm products or not, and if certified is any mixed with uncertified items
- Existence of falsehood and similar indication
- Conformity with other certified standard, etc |
| (3) Inspection of safety |
1) In case Certificate authority and NAQS(Agency) inspect the producing process and samples
2) Inspectors decision: when the confirmation of conformity with certification standard, analysis of sample should be asked
* Inspector should pick the sample from the most questioning area, and the concerning personnel(certified person) must be presented and seal the sample together
3) Client: Certificate authority will ask public test research facility that is contracted, or ask special test research facility that the certified person wants |
| (4) Secure the documentary evidence from inspection result |
| 1) When the inspector inspects the producing process or items on the market of certified items, applied owner, occupant, or interested party (owner, etc hereafter) should be in presence. However, when the inspection is not applicable due to following reasons, documentary evidence should be asked to the owner, etc. Then, according to the ordinance Article IIIXIII clause 2, written opinion guide (appendix. No. 8 form) on fine imposing should be sent to owner, etc |
- When the inspector inspects the producing process or items on the market of certified items, if owner, etc refuse to be in presence, disturb, avoid, refuse of inspection on related documents and indications
- When the inspector inspects the producing process or items on the market of certified items, if samples cannot be picked due to the refuse of inspection, disturb, avoid from owner, etc |
| 2) Inspector must receive documentary evidence from the owner when the following violation is actually committed |
- Violation of certification standard
- Violation of action such as change of indication in accordance with law article XI
- Indication of certification or similar indication on the uncertified items
- Sales or custody / exhibition of uncertified farm products mixed with certified items for the purpose of sales |
| (5) Treatment of violators |
| 1) Administrative measure targets: report the violation to the head of an agency |
¨ç When violated with certified standard, report to the head of agency who is in charge certified items producing area in applied year with attachment of documentary evidence (NAQS Notice Appendix No.10 form)
¨è After confirm the violation, the head of agency will take action in accordance with administrative measure standard(Ordinance Article XIX, Appendix1), and replay the result to Certificate authority

- The inspection of the reason for the violation of certification standard, whether it is the personal fault or something irresistible, and take appropriate action
- In case of organization, and the result is due to the member, collective action will be applied if applicable
